By accessing and using Zoldytech's services, website, or engaging with our software development solutions, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by the above, please do not use our services.
Zoldytech provides custom software development, web development, mobile application development, consulting services, and digital solutions for businesses and organizations. Our services include but are not limited to software architecture, development, testing, deployment, maintenance, and technical consulting.
Permission is granted to temporarily use Zoldytech's services for personal and commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not: modify or copy the materials; use the materials for any commercial purpose or for any public display; attempt to reverse engineer any software contained in our services; or remove any copyright or other proprietary notations.
The materials on Zoldytech's website and services are provided on an 'as is' basis. Zoldytech makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
In no event shall Zoldytech or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Zoldytech's services, even if Zoldytech or its authorized representative has been notified orally or in writing of the possibility of such damage.
The materials appearing on Zoldytech's services could include technical, typographical, or photographic errors. Zoldytech does not warrant that any of the materials on its services are accurate, complete, or current. Zoldytech may make changes to the materials contained on its services at any time without notice.
Custom software development projects are governed by separate project agreements that outline specific deliverables, timelines, and payment terms. Payment terms are typically outlined in project proposals and contracts. Late payment may result in project suspension until account is current.
All custom software developed by Zoldytech for clients belongs to the client upon full payment, unless otherwise specified in the project agreement. Zoldytech retains rights to general methodologies, techniques, and knowledge gained during the project. Any pre-existing intellectual property of Zoldytech remains the property of Zoldytech.
Zoldytech agrees to maintain the confidentiality of all client information and proprietary data shared during the course of our business relationship. Clients similarly agree to maintain confidentiality of Zoldytech's proprietary methodologies and business practices.
We are committed to protecting your privacy and handling your personal data in accordance with applicable data protection laws, including GDPR. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal information.
While we strive to ensure our services are always available, Zoldytech reserves the right to suspend or terminate services for maintenance, updates, or other technical reasons. We will provide reasonable notice when possible.
Either party may terminate service agreements with appropriate notice as specified in individual contracts. Upon termination, clients retain rights to completed work that has been paid for in full. Zoldytech may terminate services immediately for breach of terms or non-payment.
These terms and conditions are governed by and construed in accordance with the laws of Portugal, and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.
Zoldytech reserves the right to revise these terms of service at any time without notice. By using our services, you are agreeing to be bound by the then current version of these terms of service.
